Terms of Service

By accessing or using fotolabs ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not access or use the Service.

These terms apply to all visitors, users, and workspace members who access or use the Service. If you are accepting on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

fotolabs provides AI-powered photo enhancement services for real estate professionals. The Service allows you to:

• Upload property images and apply AI-driven enhancements, retouching, and style transformations
• Host and deliver processed images and RAW source files indefinitely at no additional charge
• Share client delivery links and collect revision requests directly through hosted delivery pages
• Manage projects and collaborate within a multi-user workspace

To access the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Keep your account credentials confidential and secure
• Accept responsibility for all activity that occurs under your account
• Notify us immediately at security@fotolabs.co if you suspect unauthorized access to your account

Each account belongs to a workspace. Workspace owners are responsible for the actions of all members they invite to their workspace.

fotolabs offers subscription plans billed per listing. Current pricing:

• Free: $0 — includes AI enhancement for up to 5 photos per listing, standard delivery link, and free unlimited hosting for all files.
• Essential: $25 per listing — includes AI enhancement for up to 25 photos, priority processing, branded delivery pages, and client revision tools.
• Ultimate: $30 per listing — includes everything in Essential plus twilight edits, virtual staging, window pull, and premium style templates.

All prices are in USD. Payment is collected per listing at the time of project creation, processed securely through Stripe. We do not store your full card details.

Prices are subject to change. We will give at least 30 days' notice before price changes take effect for existing customers. Listings already paid for are not subject to price changes.

If you are not satisfied with the results of your AI-processed listing, you may request a refund within 48 hours of delivery. To submit a refund request, contact support@fotolabs.co with your project details and a brief description of the issue. We aim to review all requests within one business day.

We reserve the right to decline refund requests that we determine, in our sole discretion, to be fraudulent, abusive, or outside the scope of what our Service reasonably delivers.

As part of the Service, fotolabs hosts all files associated with your account — including source images, AI-processed outputs, exports, and delivery links — indefinitely and at no additional charge. This commitment applies for as long as your account remains active.

You may delete any file or project at any time. Deletion is permanent. Upon account closure, all hosted files will be removed within 30 days. We are not liable for loss of files resulting from your deletion actions.

You retain full ownership of all images and content you upload to the Service. By uploading content, you grant fotolabs a limited, non-exclusive, royalty-free license to:

• Process and enhance your images using our AI technology
• Store, host, and serve your files to deliver the Service, including client delivery pages
• Create derivative works (enhanced images) solely for delivery to you

This license does not grant fotolabs the right to use your images for advertising, marketing, or AI model training without your explicit written consent.

You represent and warrant that you own or have all necessary rights to the content you upload, and that your content does not infringe any third-party intellectual property, privacy, or other rights.

The fotolabs platform — including its interface, AI models, processing pipeline, brand assets, and software — is owned by fotolabs and protected by applicable intellectual property laws. You may not copy, reverse engineer, or create derivative works of the platform itself.

AI-enhanced images produced through the Service are owned by you, subject to any underlying rights in your original uploaded content.

You agree not to use the Service to:

• Upload content you do not have the right to use or distribute
• Upload illegal, harmful, obscene, or fraudulent content, including images manipulated to misrepresent property conditions
• Attempt to gain unauthorized access to any part of the Service, infrastructure, or other users' data
• Use automated tools, bots, or scrapers to access the Service in ways not intended or authorized
• Resell or sublicense access to the Service without prior written consent from fotolabs
• Violate any applicable local, national, or international laws

We aim to maintain high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for losses arising from downtime, slow processing times, or temporary unavailability of the Service.

To the maximum extent permitted by applicable law, fotolabs and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or content (excluding our hosting commitment)
• Costs of substitute services arising from use or inability to use the Service

Our total aggregate liability for any claim under these terms is limited to the greater of (a) the total amount you paid us in the 3 months preceding the claim, or (b) $50 USD.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI enhancements will meet any specific aesthetic standard or that the Service will be free from errors.

You may close your account at any time by contacting ayush@fotolabs.co. Upon closure, your files will be permanently deleted within 30 days.

We may suspend or terminate your account immediately, without prior notice, if you materially breach these Terms, engage in fraudulent activity, or use the Service in a way that harms other users or fotolabs. Where feasible, we will give you notice and an opportunity to cure the breach before terminating.

These Terms are governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Norway, unless otherwise required by applicable consumer protection laws in your jurisdiction.

We reserve the right to update these Terms at any time. For material changes, we will notify you by email or in-app notice at least 30 days before the new terms take effect. If you continue to use the Service after the effective date, you accept the revised Terms.
